CLINTON & CLINTON WINS MOTION FOR SUMMARY JUDGMENT IN BED BUGS CASE
Todd Austin and Adrienne Stover of Clinton & Clinton recently won a Motion for Summary Judgment against a plaintiff who claimed to have been injured as a result of a bedbug infestation at popular hotel in Los Angeles County. The plaintiff alleges that she was bitten by bedbugs while she was a guest at the hotel, but provided no evidence of her ever staying at said hotel. In fact, the evidence, including metadata associated with photographs and video produced by the plaintiff through discovery, showed that the bedbug incident occurred at an unidentified motel, as opposed to hotel. In the Motion for Summary Judgment, Clinton & Clinton highlighted the differences between the motel at which the incident occurred and the hotel alleged to be source of the bedbugs. Having established that this was a case of mistaken identity and that the Defendants were not liable for dangerous conditions on property that they did not own, possess or control, the Court granted the hotel's Motion for Summary Judgment.
